Legal Agreement

Terms of Service: Emergency Pest Service

Reviewing operational terms, safety compliance mandates, property preparation duties, and liability parameters before receiving on-site extermination treatments.

Last Updated & Effective Date: October 1, 2026

1. Acceptance and Agreement to Terms

These Terms of Service constitute a legally binding agreement between property owners, commercial managers, and site visitors ("Client," "Customer," or "You") and Emergency Pest Pros ("Company," "we," or "our"). Accessing https://emergencypestservice.com or calling our dispatch phone at 877-379-3970 signifies unconditional acceptance of these terms. Clients who disagree with any provision contained herein must cease website use and decline technician dispatch immediately.

2. Dispatch Referral Network and Contractor Relationships

Emergency Pest Pros operates as an emergency customer intake and dispatch referral network connecting property owners with qualified, independent pest management professionals across the United States. Dispatched field technicians and extermination companies are independent third-party contractors rather than direct employees, agents, or joint venturers of the Company. Each participating field specialist maintains independent responsibility for state pesticide licensing, applicator certifications, commercial liability insurance, and regulatory compliance within their respective geographic operating territories.

3. Emergency Response, Scheduling, and Dispatch Routing

Field arrival estimates communicated over the phone reflect current technician availability, route conditions, local weather extremes, and active emergency triage. Active stinging insect swarms and indoor venomous pests receive priority queue routing. Technicians strive to maintain projected arrival windows; however, unexpected travel impediments or complex on-site treatments at preceding properties may alter actual arrival times. Clients may reschedule or modify scheduled appointments by contacting our dispatch desk promptly.

4. Mandatory Property Access and Structural Preparation

Successful chemical and mechanical pest eradication requires unobstructed physical access to target harborages. Property owners must ensure technicians receive safe access to:

  • Attics, crawlspace access hatches, basement sills, and suspended ceiling grids.
  • Exterior foundation perimeters, roofline fascia boards, and perimeter utility penetrations.
  • Interior baseboards, plumbing chases, and major kitchen appliances (refrigerators, dishwashers, and ovens).

Clients are strictly responsible for fulfilling all species-specific preparation tasks provided during intake. For bed bug thermal or chemical services, preparations include laundering bed linens at high heat, decluttering closet floors, and stripping furniture encasements. For cockroach treatments, kitchen cabinets must be cleared and surfaces degreased. Failure to complete mandatory preparation compromises treatment efficacy and may necessitate appointment rescheduling at the technician's discretion.

5. Chemical Safety, EPA Label Compliance, and Mandatory Re-Entry Intervals

Applied formulations (including microencapsulated liquid residuals, botanical aerosols, insect growth regulators, and desiccant dusts) are deployed strictly in accordance with federal Environmental Protection Agency (EPA) product labels and state department of agriculture guidelines. Clients agree to obey all safety protocols communicated by the attending applicator:

  • Mandatory Evacuation Intervals: Human occupants, children, domestic pets, and service animals must vacate treated interior spaces during application and remain outside until all wet residual sprays have dried completely, typically two to four hours.
  • Aquatic and Avian Protections: Pet birds must be removed from the structure during aerosol or thermal treatments. Aquarium water pumps and aeration bubblers must be disconnected and tanks covered with non-porous plastic sheeting.
  • Food and Contact Surface Safety: Exposed foodstuffs, cutlery, cooking implements, and infant toys must be placed in sealed containers or washed thoroughly prior to reuse if left exposed.

6. Tamper-Resistant Stations and Trap Integrity

Rodent exclusion and subterranean termite monitoring rely on specialized physical hardware installed on the property, including anchored Protecta bait stations, snap traps, electronic sensors, and in-ground bait monitors. Clients, occupants, children, and unauthorized third parties are strictly prohibited from moving, unlocking, inspecting, or tampering with deployed hardware. Decommissioning, relocating, or clearing mechanical traps is reserved exclusively for trained service technicians to prevent accidental non-target exposure.

7. Biological Realities, Sequential Protocols, and Eradication Expectations

Pest management targets complex biological organisms with multi-stage reproductive cycles. Complete eradication of entrenched infestations (such as German cockroaches carrying protective oothecae egg cases, bed bugs, or subterranean termites) frequently requires sequential treatment phases, follow-up inspections, and ongoing perimeter defense. Technicians provide detailed prognosis expectations following initial physical diagnostics. No representation is made that a single chemical spray will permanently eliminate pests without ongoing sanitary maintenance, exclusion sealing, and client cooperation.

8. Diagnostic Pricing, Quotations, and Payment Terms

Preliminary estimates provided by phone represent diagnostic baseline ranges calculated from described pest symptoms and approximate square footage. Final on-site proposals are established following physical inspection of crawlspaces, structural timber damage, and harborage severity. Payment is due upon completion of on-site service delivery directly to the attending licensed service provider under their approved payment methods.

9. Limitation of Liability and Structural Disclaimers

To the fullest extent permitted by applicable law, Emergency Pest Pros disclaims all liability for incidental, indirect, consequential, or punitive damages arising from pest control services or website utilization. Disclaimers specifically include:

  • Pre-existing structural damage, wood rot, or hollow framing timber caused by subterranean or drywood termites prior to treatment inception.
  • Electrical short circuits, appliance malfunctions, or fire hazards resulting from historical rodent gnawing on hidden interior building wiring.
  • Adverse health reactions or accidental chemical exposures occurring due to an occupant's failure to observe mandatory re-entry timing or pet evacuation protocols.
  • Actions, omissions, workmanship defects, chemical misapplications, or property damage caused by independent third-party contractor technicians.

10. Client Indemnification

Clients agree to defend, indemnify, and hold harmless Emergency Pest Pros, its officers, directors, operators, affiliates, and dispatch coordinators from and against any third-party claims, liabilities, damages, losses, or legal expenses (including reasonable attorneys' fees) arising out of or related to client negligence, failure to secure domestic pets, violation of mandatory re-entry intervals, or breach of these Terms of Service.

11. Dispute Resolution and Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these terms, website usage, or phone dispatch services shall be resolved through binding, individual arbitration rather than in a court of general jurisdiction. Clients agree to waive any right to participate in class-action lawsuits, class arbitrations, or consolidated representative actions against Emergency Pest Pros. Prior to initiating formal arbitration, parties agree to attempt good-faith informal dispute resolution by submitting written notification to contact@emergencypestservice.com.

12. Severability and Entire Agreement

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable by an arbitrator or court of competent jurisdiction, such provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. These terms constitute the entire agreement between the user and Emergency Pest Pros regarding website access and dispatch communications.
